BY REGISTERING AS A MEMBER AND INDICATING YOUR ACCEPTANCE BELOW, YOU HAVE READ AND AGREED TO THE FOLLOWING TERMS OF SERVICE ("TERMS") AS A CONDITION OF ENROLLMENT. THESE TERMS GOVERN A MEMBER'S ENROLLMENT AND USE OF SSI'S TECHNICAL SUPPORT, MEMBERSHIP, SERVICES, AND ITS WEBSITE.
1. Limited Service and Disclosures.
TELEPHONE AND ONLINE TECHNICAL SUPPORT SERVICES ARE AVAILABLE TO ONLY ONE REGISTERED USER FOR ONE REGISTERED COMPUTER SYSTEM. THE SERVICES ARE AVAILABLE ONLY TO REGISTERED MEMBERS WITH PROPER VERIFICATION OF REGISTRATION INFORMATION AND A COMPLETED CUSTOMER REQUIREMENTS FORM ON FILE. TELEPHONE SUPPORT IS ONLY AVAILABLE TO REGISTERED USERS CALLING FROM WITHIN THE UNITED STATES. TERMS AND CONDITIONS ARE SUBJECT TO CHANGE.
2. Limited Warranty, Liability and Disclaimers.
SSI's online or offline technology support membership services, our website and all information, documents, products, software, downloads, services, advice, and information (the "Materials"), including all links in the website, are provided "AS IS" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. SSI assumes no responsibility for errors or omissions with its support services, the content of its website or other information or documents which are referenced or linked. References to their services and products are provided "AS IS" without warranty of any kind, either expressed or implied. Our website or any electronic publication derived from there could include technical or other inaccuracies or typographical errors. Changes are periodically added to the materials therein. These changes will be incorporated in new versions of our website.
3. Waiver of Claims.
In no event shall SSI be or any third party service provider be liable for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of use, data, profits, or hardware damage, whether or not advised of the possibility of damage, and on any theory of liability arising out of or in connection with the use or performance of this information or services provided by SSI, including any information or services in connection with SSI's live or online technical support, whether obtained with or without charge, or with respect to any offers of computer or electronic insurance from third party providers.
4. Member's Responsibilities and Conditions.
Prior to seeking technical support, you have sole responsibility for adequate protection and backup of data and/or equipment used in connection with any technical support services or information provided by SSI and will not make a claim against SSI or its third party service providers for any reason, including, but not limited to, providing inadequate registration information, lost data, re-run time, inaccurate output, work delays or lost profits resulting from the use of the Materials or information provided. You agree to hold SSI harmless from, and you covenant not to sue SSI or its third party service providers for any claims based on using the website or its technical support. In connection with the services offered by SSI, SSI will use its best efforts to resolve basic computer technical problems of registered members. SSI will attempt to resolve the member's technical problems in a professional, reasonable and timely manner, taking into consideration the circumstances and nature of the technical problem and current policies. Online response time may be delayed due to research and inquiries. SSI's live or online technical support does not assure that every request for technical support will be resolved to the member's satisfaction. Our responses are merely technical advice or suggestions. Technical problems that may arise may be a result of software or hardware errors or problems that may not be correctable or extremely difficult to resolve. SSI has limited proprietary information from vendors, manufacturers, and developers, and may not have the ability to find them. If a court of competent jurisdiction finds that liability for damages against SSI, its agents, partners and third party providers, regardless of the warranties, disclaimers, and waivers described herein, such damages shall be limited to no more than the total fee SSI charged to the member. Such damages shall constitute liquidated damages and are a reasonable estimate of damages to compensate the member regardless of any warning of loss of or corruption of data or damage to hardware.
5. Third Party Content Disclaimer and Third Party Links.
Materials and referrals provided or referred by third party providers or links to and from third party providers or websites have not been independently authenticated in whole or in part by SSI. Users use these sites at their own risk. The links in our website may let you leave the SSI site. The linked sites are not under the control of SSI and SSI is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. SSI is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by SSI of the site.
6. Submissions of Member or Viewer Information and Links To Other Websites.
7. Payment, Cancellation, Renewal, and Non-transferability.
Premium Members will be billed on a monthly basis upon sign up. The first month will be billed immediately. The remaining payments will be billed on the last day of the month, for the up coming month. A membership will be automatically renewed for another annual or monthly membership term at the original enrollment rate and Plan unless the Member notifies SSI within 10 days of the renewal date for non-renewal. The Member must contact SSI via e-mail and request your cancellation. Members must present the correct membership number, credit card, and registration information for verification and authorization to cancel. A Member is not entitled to a refund for any reason. Your right as a registered Member to use the SSI's technical support services, the website the services and products of SSI is non-transferable. Any password or right given to registered member to use the services and products, or to obtain information or through the site documents is not transferable.
8. Force Majeure and Accessibility
SSI and/or its third party service providers are not liable for any failure or delay in performance of its services due to any cause beyond its control, including and without limitation, equipment malfunctions or periodic maintenance, computer viruses, or hackers. If SSI and/or its third party service provider's ability to render technical support services is impaired by you or circumstances beyond our or any third party provider's control, SSI and/or its third party provider may choose not to continue the service without any recourse against SSI.
SSI is a Level One Help Desk defined as answering "How to" and "How do I" type questions. SSI does not cover programming and developmental work.
